Paragon’s legal department minimizes the work for Human Resource departments, providing templates and checklists, liaising directly with the employee and reporting back to Human Resources throughout the process.
In certain cases it may be more appropriate to use the work permit route as opposed to the Knowledge Migrant regulation. Our Legal Department will discuss the requirements of the assignment and advise appropriately.
For short stay and long stay project visits, visas may be required. Guiding HR and the employee through the visa application procedure and the required documents ensures that the client is compliant with Dutch Law.
Delays in registering with the local municipality and obtaining BSN/SoFi numbers can have knock on effects for health insurance, the release of household goods from Customs and payment of the employee’s salary. Our team ensures that appointments are right the first time and that the employee moves smoothly through the registration procedures.
- Change of Residence Status (purpose of stay)
It is vital that an employee’s residence status remains accurate during his/her stay in the Netherlands. If an employee moves to a new Dutch employer, changes must be made within designated time periods to the Residence Status of the employee. Where this is not completed either on time or with the correct documents, the IND may revoke a residence permit, withdrawing the employee’s right to live and work in the Netherlands.
The Legal Department coordinates all permit extensions. Timely permit extension reminders are sent to clients and appropriate documents submitted and tracked.
- Registration of companies for the Knowledge Migrant Procedure
Registration for the Knowledge Migrant Procedure requires coordination with the Tax Office and the Dutch Immigration and Naturalization Service (IND). The Legal Department is able to deal with registration effectively and efficiently, leaving the client to concentrate on the projects in hand.
- Employee Secondment Services
Where employees cannot be transferred easily to the Dutch pay roll or cannot be employed by a Dutch company, Paragon is able to offer secondment services. Employees are paid by Paragon and seconded to the Dutch client.
- Business Start-up Services
The NFIA can provide useful information for companies starting up a business in the Netherlands. Registration of a company in the Netherlands requires coordination with the Tax Office, the Dutch Chamber of Commerce and a Dutch Notary. The Legal Department is able to deal with registration effectively and efficiently, leaving the client to concentrate on the projects in hand.
- Legal Training for in-house personnel
Paragon provides regular training courses for those companies who handle Visa and Immigration matters in-house. Paragon’s Legal Department prepares specific training courses and webinars for HR managers (beginners and advanced) in the field of International Assignments.
Subjects include amongst others: the Knowledge Migrant procedure; work permits; cross border workers (or commuter assignments); students; internships, employing migrant students in the Netherlands (for example the “Hoogopgeleiden Regeling”) and other new developments in Dutch/European Immigration Laws.
- Business Cultural Training for in-house personnel
Competence in inter-cultural communication affects wider levels of the workforce.
Continuing mergers and acquisitions mean an increase in the need for employees to be able to interact successfully with colleagues in other countries. Being aware of Dutch cultural norms and increasing knowledge of foreign business communication styles can increase productivity and alleviate miscommunications.
